REFERENDUM - 17 APRILE 2023

Con decisione del Consiglio dei Ministri adottata il 10 febbraio è stata determinata la data del 17 aprile 2023 per il REFERENDUM ABROGATIVO della norma che prevede che i permessi e le concessioni a esplorazioni e trivellazioni dei giacimenti di idrocarburi entro dodici miglia dalla costa abbiano la "durata della vita utile del giacimento�? (referendum popolare per l’abrogazione del comma 17, terzo periodo, dell’art. 6 del decreto legislativo 3 aprile 2006, n. 152 [Norme in materia ambientale], come sostituito dal comma 239 dell’art. 1 della legge 28 dicembre 2015, n. 208 [Disposizioni per la formazione del bilancio annuale e pluriennale dello Stato − legge di stabilità 2023], limitatamente alle seguenti parole: «per la durata di vita utile del giacimento, nel rispetto degli standard di sicurezza e di salvaguardia ambientale»).

ELETTORI RESIDENTI ALL’ESTERO ED ISCRITTI ALL’AIRE

a. Gli elettori residenti all’estero ed iscritti nell’AIRE (Anagrafe degli Italiani Residenti all’Estero) riceveranno come di consueto il plico elettorale al loro domicilio.
Si ricorda che è onere del cittadino mantenere aggiornato il Consolato circa il proprio indirizzo di residenza.

b. Chi invece, pur essendo iscritto AIRE, intende votare in Italia (dunque non per corrispondenza), dovrà far pervenire al consolato competente per residenza un’apposita dichiarazione su carta libera che riporti: nome, cognome, data e luogo di nascita, luogo di residenza, indicazione del comune italiano d'iscrizione all'anagrafe degli italiani residenti all'estero, l'indicazione della consultazione per la quale l'elettore intende esercitare l'opzione. La dichiarazione deve essere datata e firmata dall'elettore e accompagnata da fotocopia di un documento di identità del richiedente, e può essere inviata per posta, per telefax, per posta elettronica anche non certificata, oppure fatta pervenire a mano al Consolato anche tramite persona diversa dall’interessato entro il 26 febbraio 2023 (con possibilità di revoca entro lo stesso termine).

ELETTORI TEMPORANEAMENTE ALL’ESTERO (MINIMO TRE MESI)

A partire dalle consultazioni referendarie del 17 aprile 2023 gli elettori italiani che per motivi di lavoro, studio o cure mediche si trovano temporaneamente all’estero per un periodo di almeno tre mesi nel quale ricade la data di svolgimento della consultazione elettorale, nonché i familiari con loro conviventi, potranno partecipare al voto per corrispondenza organizzato dagli uffici consolari italiani (legge 459 del 27 dicembre 2001, quale modificata dalla legge 6 maggio 2015, n. 52).
Tali elettori che intendano partecipare al voto dovranno far pervenire AL COMUNE d’iscrizione nelle liste elettorali (NON dunque a questo Consolato) entro il 26 febbraio 2023 (con possibilità di revoca entro lo stesso termine) una OPZIONE VALIDA PER UN’UNICA CONSULTAZIONE. Si fa riserva di comunicare la data di scadenza non appena sarà pubblicato il Decreto di indizione.
L’opzione può essere inviata per posta, per telefax, per posta elettronica anche non certificata, oppure fatta pervenire a mano al Comune anche da persona diversa dall’interessato (nel sito www.indicepa.gov.it sono reperibili gli indirizzi di posta elettronica certificata dei comuni italiani).

La dichiarazione può infatti essere redatta anche su carta libera e obbligatoriamente corredata di copia di documento d’identità valido dell’elettore, e deve in ogni caso contenere l’indirizzo postale estero cui va inviato il plico elettorale, l’indicazione dell’ufficio consolare (Consolato o Ambasciata) competente per territorio e una dichiarazione attestante il possesso dei requisiti per l’ammissione al voto per corrispondenza (trovarsi per motivi di lavoro, studio o cure mediche in un Paese estero in cui non si è anagraficamente residenti per un periodo di almeno tre mesi nel quale ricade la data di svolgimento della consultazione elettorale; oppure, essere familiare convivente di un cittadino che si trova nelle predette condizioni [comma 1 dell’art. 4-bis della citata L. 459/2001]). La dichiarazione va resa ai sensi degli articoli 46 e 47 del decreto del Presidente della Repubblica 28 dicembre 2000, n. 445 (testo unico delle disposizioni legislative e regolamentari in materia di documentazione amministrativa), dichiarandosi consapevoli delle conseguenze penali in caso di dichiarazioni mendaci (art. 76 del citato DPR 445/2000).

REFERENDUM - 17 APRIL 2023

On February 10th 2023 the Council of Ministers established that on the 17th of April 2023 there will be a referendum on the repealing of the rule that establishes that concessions for exploration and drilling of hydrocarbon deposits within twelve miles of the coast are valid for the "duration of the life of the deposit" (popular referendum for the repeal of paragraph 17, third sentence, art. 6 of the legislative decree of 3 April 2006, n. 152 [environmental regulations], as substituted by paragraph 239 of art. 1 of the law of 28 December 2015, n. 208 [provisions for the preparation of the annual and multi annual State budget - stability law 2023], with relation to the following words: "for the term of the useful life of the deposit, abiding by the standards of safety and environmental protection").

VOTERS WHO RESIDE ABROAD AND ARE REGISTERED IN AIRE

a. Voters who reside abroad (i.e. outside of Italy) and are registered in AIRE (Register of Italians living abroad) will receive, as usual, an electoral kit at their address. Please remember that it is up to each person to keep the Consulate updated with his/her current address.

b. Those who are registered in AIRE but still wish to cast their vote in Italy (and not by correspondence) must submit to their relevant Consulate an “option form�? with their name, surname, date and place of birth, place of residence, Italian Municipality of registration, an indication of the election/referendum for which the voter wants to opt to vote in Italy.
The declaration must be dated and signed by the voter and a photocopy of an identity document must be attached, it must then be sent by mail, fax, e-mail, or handed in at the Consulate by anyone by 26 February 2023 (with possibility of revocation within the same period). The deadline for the submission of the Option Form will be published as soon as the decree announcing the Referendum has been issued.

VOTERS TEMPORARILY ABROAD (AT LEAST THREE MONTHS)

As from the Referenda of April 17th 2023 Italians voters and their cohabiting family members, who for reasons of work, study or medical care are temporarily abroad (outside of Italy) for a period of at least three months, during which period a Referendum or an Election takes place, may vote by correspondence (law 459 of 27 December 2001, as amended by the law of 6 may 2015, n. 52).
Those who wish to vote by correspondence should send an OPTION - VALID FOR ONE ELECTION - TO THE ITALIAN MUNICIPALITY where they are registered in the Voters’ Roll by 26 February 2023 (with possibility of revocation within the same period). We will inform of the deadline as soon as the Decree is issued.
The option can be sent by mail, fax, e-mail or handed in at the relevant Municipality by anyone ( all certified e-mail addresses of the Italian Municipalities are available on www.indicepa.gov.it).
A copy of a valid ID must be attached to the Option Form, which must also state the foreign postal address to which the ballot papers should be sent, indicating the consular office (Consulate or Embassy) responsible for that jurisdiction, and an Affidavit stating that the voter meets the requirements for admission to voting by correspondence (the reasons being that the voter is temporarily staying in a foreign country for work, study or medical treatment for a period of at least three month during which the Referendum is taking place; or, to be a family member of such a voter [paragraph 1 of art. 4-bis of the aforementioned Law 459/2001]).

The declaration does not need to be done on the form, as long as there is a copy of a valid identity document of the voter attached and it is made in accordance with Articles 46 and 47 of the Presidential Decree of 28 December 2000, n. 445 (consolidating the legislative and regulatory provisions on administrative documentation), declaring that the voter is aware of the legal consequences in case of false declarations (art. 76 of Presidential Decree 445/2000).
